Approved DOI General Applicability Waivers

The following DOI Buy America general applicability waiver requests have been approved.  Entities do not need to apply for a separate DOI Buy America Waiver for items that meet the criteria defined within one of the active waivers below.  Any questions regarding general applicability waivers should be directed to the financial assistance awarding officer for your grant or cooperative agreement.

Pacific Islands and Territories Waiver
This waiver provides a general applicability public interest waiver of the requirements of Section 70914(a) of the Build America, Buy America (BAB) included in the Infrastructure Investment and Jobs Act (IIJA) for federal financial assistance awarded for infrastructure projects located in the U.S. Pacific Island territories and Commonwealth of Northern Mariana Island, Guam and American Samoa, collectively referred to as the "Pacific Island Territories."

Tribal Consultation Waiver
This waives the Buy America Preference for financial assistance agreements issued to Federally recognized Indian tribes in keeping with the Federal Government's commitment to follow consultation polices established through Executive order 13175, Consultation and Coordination with Indian Tribal Governments.

DOI USBR WaterSMART Public Interest Waiver

 

 

 

This waiver provides a general applicability public interest waiver of the requirements of Section 70914(a) of the Build America, Buy America (BABA)Act for the U.S. Bureau of Reclamation's WaterSMART Program for financial assistance awarded for infrastructure projects. February 15, 2024

DOI USBR Rural Water Program Public Interest Waiver This is a public interest waiver of the requirements of Section 70914(a) of the Build America, Buy America (BABA) Act for the U.S. Bureau of Reclamation's Rural Water Program for seven (7) financial assistance infrastructure projects. DOI EPA Joint Final AMI Water Meter Non-availability Waiver  This Joint Department of the Interior (DOI), Bureau of Reclamation (USBR) and Environmental Protection Agency (EPA) general applicability/non-availability waiver provides approval to waive Build America, Buy America Act (BABA) for Advanced Metering Infrastructure (AMI) capable water meters due to non-availability of BABA compliant domestic products.
